What to know about Quebec

Details about this authority that prevent rejections and wasted trips:
Point 1
Quebec is Canada’s civil-law province. Its notaires are jurists who draw up authentic acts (actes notariés), much closer to a Mexican notario público than to a common-law notary public.
Point 2
The apostille is issued by Quebec’s Ministère de la Justice, not Global Affairs Canada; documents can be dropped off in Quebec City or at the Palais de justice de Montréal, by appointment.
Point 3
Almost every Quebec document is in French, so the Spanish translation must be done by a perito traductor working from French. Some Mexican states have few of them; line one up before the document arrives.
Point 4
The Directeur de l’état civil issues two formats: the certificat, a summary, and the copie d’acte, which reproduces the full record. Civil procedures in Mexico usually call for the copie d’acte.
Point 5
Many Quebecers winter in Cancún, Playa del Carmen and Tulum; the Quebec documents most often seen in Quintana Roo are marriage records, procurations notariées and notarial wills.

Vital records (QC)

Directeur de l’état civil du Québec

Location: 2535 boulevard Laurier, 4e étage, Québec, QC G1V 5C5 (Montreal: 2050 rue De Bleury, 6e étage)

Note: Order the copie d’acte (full copy of the record) of the birth, marriage or death, which is the most complete. The summary certificat may not be enough for Mexico’s Registro Civil.

Notaries public (QC)

Requirements for powers of attorney, affidavits and certified copies signed in Quebec:

  • Quebec notaires are members of the Chambre des notaires du Québec; they keep the original act (minute) and issue certified copies (copies conformes), which are what gets apostilled.
  • A procuration notariée to sell or manage property in Mexico can be drafted by a notaire; it is then apostilled, translated from French and usually formalized (protocolizado) before a Mexican notario.
  • A Quebec notarial will (testament notarié) can be presented in an estate in Mexico with an apostille and translation; its effect is decided by the Mexican notario or judge.

Frequently asked questions

Questions about Quebec apostilles

What people ask us about documents from Quebec:

Do my French-language Quebec documents need translating?

Yes. Mexican authorities require a Spanish translation, usually by a perito traductor and including the apostille. The document being in French rather than English does not change that.

Should I order the certificat or the copie d’acte?

For the Registro Civil and other civil procedures in Mexico, the copie d’acte, which reproduces the full record. The certificat is a summary and may not be enough.

Will my Quebec testament notarié work to pass on my condo in Playa del Carmen?

It can be presented in the estate proceedings in Mexico, apostilled and translated. How it applies is up to the Mexican notario or judge; many foreigners with property in Mexico also consider making a will before a Mexican notario.

Does Quebec issue the apostille, or do I go to Ottawa?

Quebec apostilles its own documents through the Ministère de la Justice. Only federal documents, such as the RCMP certificate, go to Global Affairs Canada.
